CONTRACT
If you have a child or you yourself are UNDER THE AGE OF 40 and have been medically diagnosed with cerebral palsy and you or your child has a whole bone marrow treatment at Dr. Steenblock’s Clinic and sees NO discernible positive improvements at the end of 120 days (four months) following said treatment, you will need to re-schedule another bone marrow treatment at no charge within six months of the original bone marrow procedure date since the first treatment may not have worked for a variety of reasons. If you do not have the second procedure during this time frame this contract will automatically be voided.
To make this bone marrow procedure work a patient must not acquire or have any type of infectious disease during the first month after the procedure. This requires avoidance of crowds, schools, and other family members that acquire the flu or a cold during that first month post bone marrow.
The patient must avoid falls and other injuries to the head since sudden jarring movements such as from a fall, or being hit or from riding in a car over a bumpy jerky road will damage the newly forming blood vessels.
Severe stress of any type should also be avoided and can cause failure
Alcohol, marijuana and other chemical exposures of any type and any amount should be strictly avoided during the first month after bone marrow treatment.
If your child inadvertently suffers from any of the above and fails to improve you will then be given one more chance for success by having another bone marrow procedure at no cost. If you follow all of the above recommendations and your child still does not improve you can then request a full refund of the money you paid for the procedure beginning four months after the last bone marrow treatment and will receive this within sixty (60) days time thereafter. However, these conditions must be met in order to request and receive a full refund:
INDIVIVIDUALS UNDER AGE 40 WITH CEREBRAL PALSY
(1) Individuals under age 40 (forty) with cerebral palsy must have a comprehensive functional capacity examination (FCE) by a licensed physical therapist or physiatrist prior to his or her whole bone marrow treatment and submit the results of this exam or exams before said treatment is administered. This examination must be written down in detailed, clear language and submitted prior to the procedure. This exam must include range of motion, strength testing of all extremities, both arms and legs maximum muscle group circumferences, and assessment of muscle tone in all four extremities including wrists, ankles, toes and fingers. If there is a cognitive or speech issue this must be evaluated, recorded and submitted prior to the bone marrow treatment by a licensed speech therapist. The report must be signed by a licensed speech therapist, physical therapist or physiatrist who is not related to the patient in any way nor should the patient or (in the case of a child) his or her parents be a personal friend of the examiner to prevent bias (The relationship should be professional only). A video of the examination should be included with the written report.
(2) To document the failure of the bone marrow treatments, The same functional capacity examination by a licensed physical therapist or physiatrist must be repeated four months after but no longer than six months following the adult patient or child’s second whole bone marrow treatment and the results promptly mailed by certified mail to Dr. Steenblock’s Clinic. The physiatrist, speech therapist, or physical therapist’s report must comment that they certify under penalty of law that their examination failed to show any noticeable improvement in any of the bodily functions tested 4 to 6 months after the second bone marrow treatment as compared and contrasted to the examination done prior to the bone marrow treatment (Article 1 above).
(3) Dr. Steenblock’s Clinic will refund the full amount paid by the adult patient or the parents or guardian(s) of a treated minor or to the person who paid for the treatment within sixty days after receipt of all exams and notarized documents specified in articles 1-2 above.
